TÉRMINOS Y CONDICIONES PARA PARTICIPAR EN LA SUBASTA

PRIMERO. Del Formato. La presente es una subasta pública, en la que se aceptarán pujas bajo los siguientes formatos:
a) Por correo electrónico. A la dirección: amb@bbauctions.com.mx a más tardar a las 20:00 horas del viernes 21 de Febrero, 2025.
b) En redes sociales. En Facebook en el siguiente grupo:
https://www.facebook.com/groups/708686537093132 Desde el momento de su publicación, hasta las 20:00 horas del viernes 21 de Febrero, 2025. SIN CONTEO.

c) En nuestra plataforma de subastas. https://bid.bbauctions.com.mx comienza el cierre a las 14:00 horas del sábado 22 de Febrero, 2025.

SEGUNDO. Reserva de Derechos. El Subastador se reserva el derecho de aceptar pujas, consecuentemente se reserva de igual forma aceptar personas en nuestra página de red social, plataforma de subastas y cierre de piso que, a su sola discreción considere pudiera irrumpir en la correcta ejecución de la Subasta. El realizar acciones diversas al objetivo de dicha como insultar a cualquiera de las partes participantes, emitir juicios de opinión no vinculados al objeto de esta Subasta, ofertar sus prendas en nuestra página vinculada a la red social, serán considerados como actos motivo de expulsión previa llamada de atención que realice el Subastador ya sea en público o mensaje personal. Si el Subastador conoce de algún antecedente de incumplimiento en el pago de sus obligaciones de un participante propuesto, podrá negar el acceso a la Subasta.
TERCERO. De la naturaleza de las piezas. Dado a que todos los ejemplares incluidos en el presente catálogo se consideran no auténticos, no se ofrecerá garantía alguna y, por lo tanto, el adjudicado no tendrá el derecho de reclamar la devolución total o parcial de su dinero.
CUARTO. De la inspección de las prendas. Todos los participantes pueden solicitar vía correo electrónico fotografías adicionales de las prendas de su interés, así como cita presencial para la inspección de lotes. Los adjudicados, podrán devolver alguna prenda en el caso de que tuvieran algún defecto no descrito en este catálogo limitado a reparaciones o caladas, para lo cual tendrá 3 días contados a partir de la fecha en la que recibió la prenda. Todos los lotes grupales se venden sin devoluciones.
QUINTO. De las pujas. Las pujas deberán ser claras y precisas, por lo que no se aceptarán pujas sin límite, adjudicándose cada lote al mejor postor. El precio de salida, es aquel descrito al final de cada lote en el presente catálogo, por lo que no se aceptarán pujas que se encuentren bajo este rango. En caso de empate en alguna oferta, tendrá el derecho de preferencia aquél que haya pujado primero. Los aumentos serán a discrecionalidad del Subastador, siendo genéricamente bajo el siguiente esquema:

No se aceptan pujas con fraccionales

SEXTO. Del Cierre. Usted podrá realizar sus pujas en los términos descritos en el punto Primero, incisos a, b, c. La cancelación de pujas puede hacerse hasta 24 horas antes de la hora pactada del inicio de cierre, horario que se describe en la carátula. Posterior a este término, no será permitido. En el caso de pujas en nuestra página vinculada a red social, queda estrictamente prohibido en cualquier momento; su eliminación sin previo aviso da a lugar a que el Subastador elimine al participante del grupo. El inicio de cierre de lotes será el día y hora indicada en la carátula de este catálogo. Comenzando por el lote 1 y en estricto orden ascendente. Para lo cual, la plataforma de subastas generará automáticamente los aumentos de la siguiente puja. Una vez adjudicado el lote, el Subastador no podrá aceptar puja sobre dicho lote. Considere que no se aceptarán pujas de monto inferior al descrito como precio de salida.

SEPTIMO. Del Pago. Los precios descritos en este catálogo, son calculados en moneda de curso legal de los Estados Unidos Mexicanos (MXN Pesos). Por lo que el pago será en moneda de curso legal de México en las cuentas que para tales efectos se le indiquen al momento de la adjudicación. Es posible y de encontrarse disponibles, se aceptarán pagos con tarjeta de Crédito y PayPal, los cuales se encontrarán sujetos a un cargo adicional de 5% sobre el valor total de la factura y a la determinación del tipo de cambio aplicable por parte del Subastador.

Cada adjudicación, se encontrará sujeta a un 15% adicional sobre el valor de las prendas adjudicadas por concepto de comisión. El pago de los lotes adjudicados deberá ser a más tardar 10 días naturales contados a partir del día siguiente a la culminación de la subasta. Culminado este plazo, y de no haber recibido evidencia satisfactoria del pago, el Subastador podrá cargar la tarjeta de débito y/o crédito que el participante dio de alta en su perfil de la plataforma.

OCTAVO. Envío. Los lotes adjudicados serán entregados una vez se compruebe el pago en Fuente de Pirámides No. 1-604, Lomas de Tecamachalco, Naucalpan, Estado de México, C.P. 53950 o por mensajería Express. En este segundo caso, el Subastador no es responsable por ningún motivo, incluyendo sin limitar a pérdida, falla, error o maltrato una vez haya entregado la(s) prenda(s) al servicio de mensajería. Si desea adquirir aseguramiento de su envío deberá solicitarlo al Subastador en el momento en el que se le envíe la factura. En caso de adjudicaciones a ser enviadas al extranjero, el Subastador no es responsable adicionalmente de aquellos costos que se pudieran incurrir por exportación-importación. Los envíos al extranjero podrán demorar hasta 20 días hábiles desde la recepción de su pago.

La participación en esta Subasta implica la aceptación de los términos y condiciones antes descritos, a modo de Contrato de Adhesión, renunciando a la jurisdicción que por domicilio presente o futuro (o cualquier otro), pudiera invocarse, sometiéndose expresamente las partes a los Tribunales competentes en Naucalpan de Juárez, Estado de México.

TERMS AND CONDITIONS FOR PARTICIPATING IN THE AUCTION

FIRST. About the Format. This is a public auction, in which bids will be accepted in the following formats:
a) By email. To the address: amb@bbauctions.com.mx no later than 20:00 hours on Friday, February 21, 2025.
b) On social networks. On Facebook in the following group:
https://www.facebook.com/groups/708686537093132 From the moment of publication until 20:00 on Friday, February 21, 2025. WITHOUT COUNTING.

c) On our auction platform. https://bid.bbauctions.com.mx the closing begins at 2:00 p.m. on Saturday, February 22, 2025.

SECOND. Reservation of Rights. The Auctioneer reserves the right to accept bids, and consequently reserves the right to accept people on our social networking page, auction platform and floor closing who, at his sole discretion, he considers could disrupt the proper execution of the Auction. Performing actions other than those intended, such as insulting any of the participating parties, making judgments unrelated to the purpose of this Auction, or offering your garments on our social network page, will be considered acts that may lead to expulsion after a warning from the Auctioneer, either in public or via personal message. If the Auctioneer is aware of any history of non-payment of obligations by a proposed participant, they may deny access to the Auction.
THIRD. Regarding the nature of the pieces. Given that all the items included in this catalog are considered non-authentic, no guarantee will be offered and, therefore, the successful bidder will not have the right to claim a total or partial refund of their money.
FOURTH. Inspection of the garments. All participants can request additional photographs of the garments of interest by email, as well as a face-to-face appointment to inspect the lots. The successful bidders may return any garment in the event that it has a defect not described in this catalog, limited to repairs or Rim filing, for which they will have 3 days from the date on which they received the garment. All group lots are sold with no returns.
FIFTH. Bidding. Bids must be clear and precise, so unlimited bids will not be accepted, with each lot being awarded to the highest bidder. The starting price is that described at the end of each lot in this catalogue, so bids below this range will not be accepted. In the event of a tie in any bid, the one who bid first will have the right of first refusal. Increases will be at the discretion of the Auctioneer, generally following the following scheme:

Bids with fractions are not accepted

SIXTH. End of Auction. You may place your bids under the terms described in point One, sections a, b, c. Bids may be canceled up to 24 hours before the agreed start time of the end of the auction, as described on the cover page. After this time, it will not be permitted. In the case of bids on our social network page, it is strictly forbidden at any time; its elimination without prior notice will result in the Auctioneer eliminating the participant from the group. The start of the lot closing will be on the day and at the time indicated on the cover of this catalog. Starting with lot 1 and in strict ascending order. For which purpose, the auction platform will automatically generate the increments of the next bid. Once the lot has been awarded, the Auctioneer will not be able to accept bids on that lot. Please note that bids for an amount less than the starting price will not be accepted.

SEVENTH. Payment. The prices described in this catalog are calculated in the legal currency of the United Mexican States (MXN Pesos). Therefore, payment will be made in the legal currency of Mexico into the accounts indicated for such purposes at the time of award. It is possible and if available, payments by credit card and PayPal will be accepted, which will be subject to an additional charge of 5% on the total value of the invoice and to the determination of the applicable exchange rate by the Auctioneer.

Each award will be subject to an additional 15% on the value of the items awarded as commission. Payment for the lots awarded must be made no later than 10 calendar days from the day following the end of the auction. Once this period has elapsed, and if satisfactory proof of payment has not been received, the Auctioneer may charge the debit and/or credit card that the participant registered in their platform profile.

EIGHTH. Shipping. The awarded lots will be delivered once payment has been verified at Fuente de Pirámides No. 1-604, Lomas de Tecamachalco, Naucalpan, Estado de México, C.P. 53950 or by Express courier. In this second case, the Auctioneer is not responsible for any reason, including but not limited to loss, failure, error or mistreatment once the item(s) has been delivered to the courier service. If you wish to purchase insurance for your shipment, you must request it from the Auctioneer at the time the invoice is sent to you. In the case of awards to be sent abroad, the Auctioneer is not additionally responsible for any costs that may be incurred for export-import. Shipments abroad may take up to 20 working days from the receipt of your payment.

Participation in this Auction implies acceptance of the terms and conditions described above, by way of a Contract of Adhesion, waiving the jurisdiction that could be invoked by present or future domicile (or any other), with the parties expressly submitting to the competent Courts in Naucalpan de Juárez, State of Mexico.
